If I used unemployment benefits during my OPT, do I still have the 60-day grace period?
Hey @H1BSlave — good question (and great username, still makes me chuckle ).
If you used unemployment benefits during your valid OPT period — and didn’t exceed the allowed 90 days of unemployment — then yes, you should still get the standard 60-day grace period after your OPT ends.
The grace period is there to let you transfer schools, change status, or prepare to leave the U.S. — it’s not affected just because you used unemployment benefits properly.
That said, if there’s any gray area (like going over the 90 days), it’s smart to check with your DSO or an immigration attorney.
Hope that clears it up a bit!
