For the current time frame how long will the wait by to make H1B limit its 6 year cap. For that I assume you need to get to I140 stage. 2 years? 3?
For those who are on opt or cpt, if you file for PERM with no H1B yet what do you do?
Normally, the PERM process takes 1-2 years, followed by the I-140 stage. Due to the backlog in EB-2, including many NIW cases, I-140 approval could take an additional 1-2 years.
For Indian citizens, the timeline to file I-485 could be around 10 years, while for Chinese citizens, it’s typically 5+ years.
Once your I-140 is approved, you can extend your H-1B visa indefinitely without the usual time limits.
For those still on an F-1 visa, maintaining legal status after OPT expires is crucial. This means considering options like enrolling in a Day 1 CPT school, applying for an O-1 visa, or securing another legitimate visa status.
