COS RFE to B1B2 after After H1B layoff

After being laid off and switching to a B2 visa for job hunting, I initially applied for a six-month extension but was only granted four months. Now, four months have passed without securing a job, so I applied for another B2 extension. Last week, the extension request received an RFE (Request for Evidence). Has anyone recently encountered a similar situation? What are the chances of rejection after an RFE? Are there any other options available at this point? Does anyone have recommendations for a lawyer experienced in handling such cases? (I’m hesitant to take any more risks.)

Hey @tomorrow2025 — really sorry you’re going through this. It’s a tough spot, but you’re asking all the right questions.

:pushpin: A few quick notes (not legal advice, just patterns I’ve seen):

  • RFE after B2 extension isn’t unusual, especially after multiple extensions. USCIS typically wants more proof you’re still a genuine visitor (and not working).
  • Approval odds depend a lot on how strong your new evidence is — ties to your home country, financial support, clear non-immigrant intent, etc.
  • Other options: Some folks shift gears by applying for F-1 (if they find a school fast) or even considering leaving/re-entering with a fresh visa later — but each path has risks.

Since you’ve already had a tight timeline, I’d really recommend speaking with a good immigration attorney who’s handled B2 extension + fallback strategies.

Wishing you the best — hang in there :speech_balloon:

This situation is pretty complicated I would definitely consult with a lawyer as well as letting them handle this RFE case.
RFE, rather than NOID, is not a sign that equals high rejection profile.
Instead, most RFE did get green light if you can provide the missing information USCIS is looking for. Again, I would caution every move from now because if you get a COS RFE and then rejection it stays in your immigration history.
