Reflections from NAFSA: What International Students Should Know About Recent F-1 Visa Revocations

As someone working in the legal field and also an international student, I recently attended the NAFSA conference where the hot topic was the recent wave of F-1 visa revocations. I wanted to share a few important insights and takeaways that may help others who are navigating this difficult and confusing situation.

1. What Happens After Your Visa Is Revoked?

Unfortunately, once your F-1 visa is revoked, the courts do not have the power to reinstate it. In other words, the legal system cannot directly overturn the revocation. However, litigation is still an option—some students have challenged the decision by questioning the legitimacy of the revocation, and there have been cases where students have won.

2. Should You Leave the U.S.?

There’s still uncertainty regarding whether students are required to leave the U.S. immediately. Many immigration attorneys recommend consulting legal counsel before making any decisions. If you leave the country, getting a new F-1 visa may be very difficult, as the visa revocation will remain permanently in your immigration record.

3. Can You Apply for Reinstatement?

Yes, reinstatement is possible, especially for students who are currently on OPT and planning to start a new academic program. Your chances may be higher in such cases, but you should still consult with a qualified attorney to assess your individual situation.

4. Is the CBP One App Helpful?

According to immigration lawyers, the CBP One app offers no real advantage in this context. It will NOT buy you more time or affect your legal status in any meaningful way. Avoid relying on it as a solution.
